Spotlight: Truck Accidents
 

Marshall Case

Plaintiff in small pick-up truck t-boned on passenger by 2 ton tool truck van that ran a red light. The impact sent the small truck into a light pole. Plaintiff, a 55 year old electrician and retired navy seal, broke jaw, right hand, ruptured right bicep, herniated C5 and C6 disks, and underwent 2 level fusion. The steering wheel was bent upon impact. Plaintiff settled for $450,000.

Fatal Trucking Accident Case

Our client in this wrongful death case was the extended family of a husband, wife, and infant child killed in a car-truck accident on the 710 Freeway. The car the family was riding in became sandwiched between two semi-trucks. When the first truck stopped suddenly, the truck behind them did not. Their car was pushed beneath the front truck and exploded in flame. Our investigation proved that the truck behind them was at fault for this tragic, fatal truck accident. Settlement was $1.5 million.

Cameron Case

Work van did not have a seat for plaintiff to sit and no seat belt. It was a cab over so plaintiff sat on the wheel well. There was a sliding door behind the cab. The slider door flew off the tracts on the impact from a truck hitting the van from behind. A ladder in the bed of the van came through the opening, hitting plaintiff in the lower back causing a herniated disc at L4 L5 level. Workers Comp paid $62,000 and want reimbursement. Motions were made to deny the Workers Comp. Lien for failure to provide a safe working condition. Per Case of Witt v Jackson Comp Lien paid 0. Rear ended Highway 8, San Diego settled for Policy Limits of $100,000.
